Succession from ASA
The ARB succeeded the Advertising Standards Authority (ASA) following the ASA’s liquidation in 2018. The exact commencement date varies slightly across secondary sources; “October 2018” is the generally-accepted start across SA legal commentary and the site uses “October 2018.” The ARB’s NPC registration NPC 2018/5288775/08 is consistent with a 2018 establishment.
Scope of rulings
The ARB’s rulings bind its members. Non-members can still be the subject of a published ruling — the ruling creates reputational pressure and a formal record, but is not directly binding on the non-member. This distinction is important for consumer-facing complaints: a Takealot supplier might or might not be an ARB member, and the practical force of a published ruling depends on that membership status.
